Landowners with springs that originate on their property and flow off-premises may store spring water for fire prevention and fire suppression purposes with a permit from the Water Resources Department

Two permit pathways available: a water right permit for a reservoir under ORS 537.409, or a permit to use stored water under ORS 537.147

Stored water use is restricted exclusively to fire prevention and suppression; any other use requires a separate permit application under standard ORS 537.140 procedures

Permits require fish screens, by-pass devices, fish passage as required by the State Department of Fish and Wildlife, and measuring devices at each point of diversion

Takes effect on the 91st day following adjournment of the 2025 regular legislative session
