Health care practitioners present when a child is born alive must provide the same standard of care to preserve life and health as they would for any other child born at the same gestational age, regardless of whether the birth resulted from induced abortion, cesarean section, or natural labor

"Born alive" is defined as complete expulsion or extraction of a child showing signs of life including breathing, heartbeat, umbilical cord pulsation, or voluntary muscle movement at any developmental stage

Children born alive outside a hospital must be immediately transported and admitted to a hospital after initial lifesaving care is provided

Violations constitute unprofessional conduct subject to disciplinary action by the Oregon Medical Board, and health care practitioners or clinic employees who witness violations must immediately report them to state law enforcement

The pregnant person or the person responsible for fertilization may sue for actual and punitive damages, with court protections available to preserve anonymity of specified parties from public disclosure
