Public servants who fail to make mandatory reports of suspected child abuse commit the crime of official misconduct in the second degree, a Class C misdemeanor

Prosecution for official misconduct based on failure to report child abuse may be commenced at any time while the defendant holds public office or employment, or within five years after leaving office

The statute of limitations for this specific type of official misconduct may be extended by up to six years beyond the standard limitation period

Amendments apply to offenses committed before, on, or after the effective date but do not revive prosecutions already barred by existing statutes of limitations
