Police officers and firefighters in the Public Employees Retirement System (PERS) would qualify as disabled if unable to perform their specific job duties at the time of disability, rather than being required to prove inability to perform any work for which qualified

Other PERS members would continue under the existing standard requiring inability to perform any work for which qualified to receive disability benefits

Disability retirement cancellation for police officers and firefighters would occur only when the member can return to performing the specific work they did before becoming disabled

Amendments apply to ORS 238.320, 238.325, 238.340, 238A.155, and 238A.235, covering both Tier 1/Tier 2 PERS members and Oregon Public Service Retirement Plan (OPSRP) members

Changes apply to members currently considered disabled on the effective date of the act, as well as those who become disabled after the effective date
