Courts must issue firearm prohibition orders at first appearance for persons charged with misdemeanor unlawful possession of a controlled substance, requiring surrender of all firearms within 24 hours to law enforcement, a gun dealer, or a third party

Prohibition ends when the person completes a substance use disorder assessment/screening and recommended treatment; for repeat offenses, the person must demonstrate one year of abstinence from controlled substances

Violating the firearm prohibition is punishable by up to 364 days imprisonment, a $6,250 fine, or both

Deflection programs (diversion programs for drug offenses) must require participants to agree not to possess firearms and to transfer all firearms until program completion as a condition of participation

Declared an emergency measure, taking effect immediately upon the Governor's signature
