Violations of ORS 746.230, 746.650, 746.663, or 746.686 (insurance claim settlement practices) and failure to provide notices under ORS 746.687 are now enforceable as unlawful trade practices under Oregon's UTPA

Private individuals harmed by insurance violations may sue for actual damages or $200 statutory damages (whichever is greater), plus equitable relief, punitive damages, and attorney fees

Prosecuting attorneys (Attorney General or district attorneys) may only take enforcement action against insurance-related violations if the Director of the Department of Consumer and Business Services first requests such action

Claims related to medical malpractice settlement practices and activities of insurance producers regulated under ORS 744.052-744.089 are explicitly exempted from private lawsuits under this provision

Applies only to acts occurring on or after the effective date of the 2025 Act
