Residents of memory care facilities have the right to organize and participate in independent family councils—groups of residents, family members, or legal representatives that meet privately in person or virtually

Facilities must notify new residents and their legal representatives of the right to form or join family councils and provide contact information for any existing council at admission

Facilities must provide entry area display space for council information, meeting space with reasonable privacy, and notify residents and families of upcoming meetings when requested

Staff and visitors may attend council meetings only by invitation, and facilities must designate a staff person to respond to council requests or grievances in a timely manner

Facilities are prohibited from discriminating or retaliating against residents based on council participation, or willfully interfering with the formation, maintenance, or promotion of a family council
