Government employees (federal, state, local agencies, cities, counties, Indian tribes, utilities) may apply non-restricted-use pesticides using battery-powered devices holding 5 gallons or less without obtaining a public applicator license or public trainee certificate

Exemption does not apply to pesticide applications made on school campuses, which still require licensed applicators

Employers must provide training on safe handling, application, storage of pesticides and proper use of machine-powered devices before employees can use this exemption

Employers must maintain training records for each employee throughout their employment and make records available to the State Department of Agriculture upon request

Operative date is January 1, 2026, with the act taking effect 91 days after the 2025 legislative session adjourns
