Hospitals and health systems must report annually to the Oregon Health Authority on facility fees charged at hospital-based facilities, including patient visit numbers, fee amounts paid by insurers and patients, and total revenue from facility fees

Patients must receive notice of facility fees at appointment scheduling, upon arrival, and (for emergency patients) after stabilization, with the notice explaining the fee amount, potential financial liability, and the right to request a fee reduction

Facility fees may only be charged for services provided on the hospital's campus (within 250 yards of main buildings) or at facilities with an emergency department

Facility fees are prohibited for services billed using "evaluation and management" or "assessment and management" CPT codes

Attempting to collect a prohibited facility fee constitutes an unlawful collection practice under Oregon law, and the Oregon Health Authority may impose civil penalties up to $500 per day for violations
