Authorizes the Director of the Employment Department to require drug testing for initial unemployment benefit claims if the claimant was terminated for unlawful drug use or if suitable work is only available in occupations that regularly conduct drug testing (as listed in 20 C.F.R. 620.3)

Drug testing costs must be paid by the Employment Department and cannot be charged to claimants directly or deducted from benefits

Claimants who fail a drug test may be disqualified from receiving benefits until they meet requalification requirements under ORS 657.176(2) and pass another drug test

Continued claims for benefits are exempt from drug testing requirements; only initial claims are subject to testing

Provisions become void if the U.S. Secretary of Labor determines they fail to meet Social Security Act or Federal Unemployment Tax Act requirements
