Summary of Oregon Senate Bill 867

• Expands sanctions for schools found in noncompliance with anti-discrimination laws to include mandatory policy adoption, training requirements, technical assistance, and student remedies such as access to missed activities or reimbursement for costs incurred due to discrimination

• Grants the Department of Education authority to investigate sexual conduct allegations against school employees, contractors, agents, or volunteers who provided services within two calendar years prior to when the suspected conduct was committed

• Excludes from "education provider" definition entities serving only pre-kindergarten students, unless the provider is under direct control of a K-12 education provider

• Requires the Department of Education to retain investigation documents and materials for 75 years and modifies notification procedures following investigations to separately inform reporters of findings and notify relevant regulatory boards of substantiated reports

• Authorizes law enforcement agencies to share child abuse reports and records with the Department of Education for investigations conducted under ORS 339.391
