Parental income must be disregarded when determining Medicaid eligibility for children under 18 with physical disabilities or chronic illnesses requiring hospital or nursing home level of care

Oregon Health Authority must establish level of care criteria and assessment tools for admission to psychiatric facilities serving individuals under 21, with those meeting criteria eligible for medical assistance if home and community-based services can prevent institutional placement

Individuals who stabilize with home and community-based services or are discharged from institutional settings continue to meet eligibility criteria if removing services would risk institutional placement

Amends the Medically Involved Home-Care Program to remove enrollment caps and expand services including home nursing care, durable medical equipment, and respite care for medically involved children

Oregon Health Authority must seek federal CMS approval by January 1, 2026, with key provisions becoming operative upon federal approval; declared an emergency effective upon passage
