Contracting agencies must issue change orders within 30 days after accepting additional work outside the original public improvement contract scope, or pay interest at three times the Federal Reserve discount rate on 90-day commercial paper (capped at 30%)

Contractors must issue change orders to subcontractors within 10 days of receiving a change order from the contracting agency for out-of-scope work, or pay 1% monthly interest until the change order is issued

Private construction contracts are subject to the same requirements: owners must issue change orders within 30 days for accepted additional work, with 1.5% monthly interest penalties for non-compliance

Subcontractors who request a change order within 30 days of completing accepted additional work can shift interest liability to the contracting agency or owner if the contractor or first-tier subcontractor properly requests the change order

Amendments to public contract provisions (ORS 279C.570) become operative January 1, 2027; the act takes effect 91 days after the 2026 legislative session adjourns
