School district boards and higher education governing bodies must adopt policies addressing responses when federal immigration authorities enter school property or campuses, with requirements becoming operative July 1, 2026 and first applying to the 2026-2027 school year.

Designated administrators must respond to immigration authority presence by recording time and location, consulting legal counsel when feasible, verifying credentials and purpose, and determining whether access is sought under a judicial warrant or court order.

Schools must notify students, parents/guardians, and the school community when federal immigration authorities are present, including the general location and whether operations are affected, while prohibiting disclosure of personally identifiable information or information that threatens safety.

Annual training for employees is required on expectations regarding federal immigration authority efforts, along with written guidance clarifying differences between court orders and administrative orders, public versus private areas, and what constitutes interference with lawful access.

The Department of Education and Higher Education Coordinating Commission must submit annual reports to the legislature on notifications issued, and the State Board of Education and HECC must adopt model policies in consultation with the Attorney General.
