Health care practitioners present when a child is born alive must provide the same degree of professional skill, care, and diligence to preserve the child's life as would be provided to any other child born at the same gestational age, regardless of whether the birth resulted from induced abortion

Children born alive outside a hospital must be immediately transported and admitted to a hospital for continued care

Health care practitioners or clinic employees who witness violations must immediately report them to state law enforcement

Violations constitute unprofessional conduct subject to disciplinary action, including potential license suspension or revocation by the Oregon Medical Board

The person who was pregnant or the person responsible for fertilization may bring civil actions for actual and punitive damages against violating practitioners, with courts required to protect the anonymity of the pregnant person if they do not consent to disclosure
