Violations of Oregon Insurance Code provisions (ORS 746.230, 746.650, 746.663, 746.686) and failure to provide notices under ORS 746.687 are added as unlawful trade practices enforceable under the Unlawful Trade Practices Act

Removes the previous exemption that excluded insurance from the definition of "real estate, goods or services" under UTPA, and removes the exemption for licensed insurance producers from telephone solicitation rules

Courts may now award equitable relief in addition to monetary damages under UTPA, and private individuals can seek both actual/statutory damages and appropriate equitable relief

Prosecuting attorneys cannot take action against insurance-related unlawful practices unless the Director of the Department of Consumer and Business Services first requests the action; the director may join as a party

Exempts from private lawsuits any attorney activities on behalf of insurers/insureds related to claims under ORS 746.230, and exempts insurance producer activities regulated under ORS 744.052 to 744.089
