State Forester must determine available state forestland and adopt sustainable timber harvest levels (planned 10-year harvest volumes in annual increments) by rule at least every 10 years, before material management changes, or when forestland conditions change materially.

Initial sustainable timber harvest level must be adopted on or before January 1, 2027.

Harvest levels must account for forestland conditions, State Forester policies, federal habitat conservation plans, the Oregon Forest Practices Act, and any unharvested timber from previous harvest levels (unless prevented by disease, wildfire, or storm damage).

Any person may seek a court order from Marion County Circuit Court if the State Forester fails to establish required harvest levels; revenue recipients under ORS 530.110 or 530.115 may seek court orders if forestland is not managed to produce the sustainable harvest level.

Declared an emergency, effective immediately upon passage.
