Ski area operators may require adults (18+) purchasing lift tickets or season passes to sign liability releases for ordinary negligence claims related to skiing injuries, but cannot require releases for gross negligence, non-skiing injuries, equipment-related injuries (snowmobiles, chair lifts, etc.), or violations of statutory duties

Purchasers must be offered an opt-out from the liability release for a fee not exceeding 10% of the ticket or pass price; releases broader than permitted are void in their entirety

Ski area operators must inspect slopes before opening and mark natural hazards (bare spots, creeks, rocks, stumps) and human-made structures not visible from 100 feet, covering obstructions with shock-absorbent material

Operators must design and maintain constructed features (terrain parks, jumps, rails, half-pipes) consistent with industry best practices and comply with ANSI B77.1-2022 safety standards for passenger ropeways

Violations of operator duties constitute negligence to the extent they cause injury; the law applies to claims arising on or after the effective date
