Health insurance policies in Pennsylvania cannot exclude coverage for medically necessary mental health, behavioral health, or speech therapy services solely because they are provided in a school setting

Covered school entities include public schools, charter schools, cyber charter schools, private schools, nonpublic schools, intermediate units, and area career and technical schools (excludes postsecondary institutions)

Insurers may still exclude coverage if the provider is unlicensed, the service is not medically necessary, or the school entity is legally obligated to provide the service under an IEP or Section 504 plan

Civil penalties for violations range up to $5,000 per action ($10,000 for willful violations), with a maximum of $500,000 per insurer per calendar year

Takes effect immediately upon enactment, applying to new policy filings or policies issued/renewed 180 days after the effective date
