Fee schedule rates for home and community-based services through intellectual disability and autism programs administered by the Office of Developmental Programs must increase annually by the Consumer Price Index percentage change, beginning October 1, 2026

Providers must increase direct support professional wages by the same CPI percentage by January 1 of each applicable fiscal year, with the department publishing a lower bound wage rate that providers cannot pay below

Financial penalties for non-compliant providers take effect July 1, 2027, calculated based on hours worked multiplied by the difference between actual wages paid and the required lower bound rate

Penalties collected are deposited into the Home and Community-Based Services for Individuals with Intellectual Disabilities Augmentation Account under The Fiscal Code

Providers must report annually on the number of direct support professionals, average and starting wages by service type, and detailed compensation information including benefits and payroll taxes
