Mental health professionals must obtain written informed consent from patients before using AI to record or transcribe therapy sessions, disclosing both that AI will be used and its specific purpose

AI providers are prohibited from marketing or programming AI systems to claim they can provide therapy, act as therapists, counselors, psychiatrists, or any mental health professional

Mental health professionals cannot allow AI to make independent therapeutic decisions, directly interact with clients therapeutically, generate treatment plans without professional review, or detect emotions/mental states

Violations constitute unprofessional conduct under existing licensing laws for nurses, psychologists, osteopathic physicians, medical doctors, social workers, marriage/family therapists, and professional counselors

Exceptions apply to religious counseling, peer support services, and publicly available self-help/educational materials; the act takes effect 60 days after enactment
