Pharmacy benefits managers (PBMs) would be prohibited from acquiring or holding, directly or indirectly, permits to operate retail pharmacies in Pennsylvania, with the State Board of Pharmacy required to revoke or refuse renewal of permits held in violation

Limited-use permits may be issued to PBM-affiliated pharmacies that provide access to rare, orphan, or limited-distribution drugs otherwise unavailable in the market, for a minimum period of 90 days

The board must assess all pharmacy permits as of July 1, 2026, and notify permit holders expected to be in violation at least 90 days before the January 1, 2027 enforcement date

Affected pharmacies must notify all patients and prescribing providers who used the pharmacy in the preceding 12 months at least 60 days before January 1, 2027, including a list of compliant Pennsylvania pharmacies

An exemption exists for employer-sponsored pharmacies that hold interest in a PBM but serve only that employer's employees and dependents exclusively through the affiliated PBM
