School boards may apply to the Department of Education for waivers from provisions of the Public School Code, State Board regulations, or Secretary of Education standards to improve instructional programs or operate more effectively and economically

Intermediate units may apply for waivers on behalf of all member school districts, but only after receiving approval resolutions from every member district's board

Department of Education must approve, disapprove, or request modifications within 60 days of receiving an application; failure to act results in automatic approval

Waivers require evaluation after 5 years and are automatically renewed if the evaluation shows improvement in student performance, instructional programs, or school operations

Numerous provisions are exempt from waiver eligibility, including academic standards and assessment requirements, special education services, student attendance rules, anti-discrimination provisions, and collective bargaining agreements
