Data centers operating in Pennsylvania must submit annual reports to the Department of Environmental Protection detailing their energy consumption (in kilowatt-hours) and water consumption (in gallons) by July 1 each year, beginning July 1, 2027

Reports must include monthly energy and water usage, peak load averages, energy sources, water sources, waste heat production (in BTUs), and any efficiency measures or on-site electricity generation efforts undertaken

The Department of Environmental Protection, in consultation with the Public Utility Commission, must publish an annual report on statewide data center consumption trends, environmental impacts, and recommendations, submitted to the Governor and relevant legislative committees

Non-compliant data centers face civil penalties of $10,000 per day until reports are submitted, with collected penalties deposited into the local low-income electric customer assistance program

Proprietary information may be exempt from public disclosure, but all aggregated and anonymized data must be made publicly available
