When a state correctional institution permanently closes and its land is offered for sale, the Department of Corrections must notify the county and offer 2% of the total acreage at no cost for affordable housing development.

Counties have 60 days to accept the land by passing a resolution and submitting a detailed development plan specifying the number of affordable housing units to be constructed and leased.

Counties must begin construction permitting within 5 years of receiving the deed and have affordable housing units available for lease within 10 years, or the land reverts to the Commonwealth.

Applies only to sales of state correctional institution property occurring on or after the act's effective date, which is 60 days after enactment.
