School entities must adopt or amend bullying policies beginning with the 2026-2027 school year to include disciplinary consequences for bullying based on a student's actual or perceived sex, sexual orientation, gender identity, or gender expression.

Policies must establish best practices for supporting nonbinary and transgender students during transition, including respecting student privacy and using the student's stated gender identity and pronouns.

Schools must post the policy in student handbooks, on websites, in every classroom, and at prominent locations in school buildings, with annual reviews of procedures with students.

School entities must review their policies every three years and annually report to the Department of Education on bullying policies and any gender-based bullying prevention, intervention, and education programs.

The act takes effect 60 days after enactment and amends the Public School Code of 1949 by adding Section 1303.3-A.
