Nondisclosure and nondisparagement clauses signed before a sexual assault or sexual harassment dispute arises cannot be enforced in Pennsylvania courts when the alleged conduct violates state law.

Applies to employment agreements, independent contractor agreements, and consumer contracts with goods and services providers.

Protections for trade secrets and proprietary information remain intact; employers and employees may still enter agreements protecting such information.

Does not override federal or state laws governing the use of pseudonyms in sexual assault or harassment claims.

Takes effect 60 days after enactment and applies only to claims filed on or after that date.
