Ambulatory surgical facilities and hospitals must adopt and implement policies to mitigate surgical smoke exposure by January 1, 2026, or 90 days after the act's effective date, whichever is later

Smoke evacuation systems must be used during each procedure that generates surgical smoke, which is defined as gaseous byproduct from heat-producing tools used for dissection and hemostasis

Surgical smoke mitigation policies must be developed in consultation with the entire surgical team at each facility

Facilities retain flexibility to select any smoke evacuation system that accounts for surgical techniques, patient safety, and the safety of operating room personnel

Amends the Health Care Facilities Act (P.L.130, No.48 of 1979) and takes effect immediately upon enactment
