Expands food donation liability protection by removing the requirement that food be donated specifically to charitable or religious organizations, now covering any good faith donation for free distribution to needy individuals

Adds "labeled date code recommended by the manufacturer" to the list of acceptable reasons food may not be readily marketable but still qualify for donation immunity protection

Maintains existing requirements that donors must reasonably inspect food and find it fit for human consumption at the time of donation to receive immunity

Immunity does not apply when damages result from donor negligence, recklessness, intentional misconduct, or when the donor knew or should have known the food was tainted or harmful

Takes effect immediately upon enactment
