Extends special education enrollment through the 2035-2036 school year for eligible students, allowing attendance until the school year in which they turn 22 years old

Eligibility requires students to have not graduated high school, have an active IEP during the year they turned 21, and have been continuously enrolled in a school entity since the 2020-2021 school year

Parents or guardians must submit an election form to the Department of Education by April 1 of the school year the student turns 21, with the Secretary required to approve or deny within 30 days

Public school entities must include enrolled students in average daily membership calculations and comply with federal disability education law (IDEA) and state special education regulations

Students age 21 or older with active IEPs count toward special education personnel caseload limitations under 22 Pa. Code § 14.105
