Authorizes public or private entities, including nonprofits, to establish syringe service programs to prevent disease transmission and reduce mortality among individuals who use controlled substances

Excludes syringes, needles, and harm reduction supplies (including fentanyl test strips) provided through authorized syringe service programs from the definition of "drug paraphernalia," and prohibits prosecution for residual drug amounts in these supplies

Requires programs to provide sterile needles/syringes, referrals for HIV/hepatitis/substance use disorder/mental health treatment, unique participant ID cards, and secure disposal sites for used syringes

Prohibits programs from operating within 500 feet of schools (250 feet in Philadelphia and Allegheny counties) or within 250 feet of playgrounds, with exemptions for existing programs and licensed health care facilities

Mandates annual registration with the Department of Health, annual reporting on participants and services provided, and grants programs civil and criminal immunity absent willful misconduct or gross negligence
