PA SB1120

Establishes a private right of action allowing any person with an adversely affected interest to file civil lawsuits to enforce Pennsylvania's Oil and Gas laws (Title 58) against violators or against the Department of Environmental Protection for failing to perform its duties

Private lawsuits against alleged violators are barred if the department is already diligently prosecuting a civil action for the same violation, though affected persons may intervene in such cases as a matter of right without posting bond

Grants jurisdiction to county courts of common pleas and Commonwealth Court to hear these enforcement actions

Preserves existing legal rights and remedies, and does not preempt well control emergency response provisions

Takes effect 60 days after enactment
