Civil immigration arrests are prohibited within state facilities, local government facilities, or within 1,000 feet of such facilities unless the arresting authority presents a valid judicial warrant or judicial order authorizing the arrest and detention of the named individual.

The restriction does not apply to civil immigration arrests directly related to a judicial or administrative proceeding occurring within the state facility.

Individuals subjected to civil immigration arrests in violation of the law may bring civil action against state entities or their officers, employees, or agents who knowingly or recklessly permitted or facilitated the violation.

Available relief includes general and special damages (minimum $500), punitive damages, attorney fees and costs, and injunctive relief; sovereign immunity does not apply as a defense.

Actions must be filed within two years of the alleged violation, and the act takes effect immediately upon enactment.
