Construction sites disturbing more than one acre but less than five acres may apply to the Department of Environmental Protection for a waiver from National Pollutant Discharge Elimination System (NPDES) permit requirements for stormwater discharges

Waivers must comply with federal criteria under 40 CFR 122.26(b)(15)(i), and the department is required to grant the waiver if the site satisfies those criteria

Amends Section 402(c) of The Clean Streams Law (1937) by adding a new paragraph regarding potential pollution from construction activities

Takes effect 60 days after enactment
