Amends Section 5328(a)(14) of Title 23 (Domestic Relations) regarding factors courts must consider when awarding child custody

Lawful use of medical marijuana under Pennsylvania's Medical Marijuana Act (2016) cannot alone be used as evidence to determine child custody decisions

Lawful medical marijuana use by a party cannot alone require that party to undergo drug testing in custody proceedings

Courts must still consider history of drug or alcohol abuse as a factor in custody determinations, but legal medical marijuana use is explicitly excluded from this consideration

Takes effect 60 days after enactment
