Establishes procedures for partitioning "heirs' property" — real property held in tenancy in common where at least one cotenant inherited from a relative, 20% or more of interests are held by relatives, and no written agreement governs partition

Requires courts to determine fair market value through appraisal by a licensed Rhode Island appraiser, with parties having 30 days to object after receiving notice of the appraised value

Creates a cotenant buyout process allowing non-selling cotenants 45 days to elect to purchase the interests of cotenants requesting partition by sale at the court-determined fair market value

Mandates partition in kind (physical division into separate parcels) as the preferred remedy unless it would cause "great prejudice" to cotenants, considering factors such as sentimental attachment, ancestral value, duration of family ownership, and current lawful use

Requires open-market sales through a licensed real estate broker at no less than the determined value, with the broker filing reports within 7 days of receiving qualifying offers; takes effect January 1, 2027
