Prohibits online retailers from using algorithms, AI, or data processing systems to charge individual consumers higher prices based on personal data such as geolocation, device identifiers, browsing history, demographics, or past purchases

Permits dynamic pricing based on general market conditions, inventory levels, time-of-day, or other factors that do not incorporate individualized personal data, as well as price decreases including discounts, promotions, and loyalty rewards

Requires online retailers to display a conspicuous disclosure when prices are influenced by non-prohibited dynamic pricing factors, stating the price may be affected by market conditions, inventory, or timing

Classifies violations as deceptive trade practices enforceable by the Attorney General, with civil penalties of up to $100 per violation, where each instance of noncompliance constitutes a separate violation

Takes effect immediately upon passage
