Pharmacy benefit managers (PBMs) must reimburse non-affiliated pharmacies at rates equal to or greater than the net effective reimbursement paid to their affiliated pharmacies for the same drugs or services, including all fees, adjustments, and incentives

PBMs are prohibited from imposing contractual terms, performance metrics, or reimbursement methodologies that result in lower payments to non-affiliated pharmacies compared to affiliated ones

Medicaid managed care organizations and their contracted PBMs must comply with these reimbursement parity and anti-discrimination requirements for all Medicaid pharmacy benefits

PBMs must provide reimbursement data to the Office of the Health Insurance Commissioner (OHIC) upon request to verify compliance, and evasion through affiliation structures or subcontracting arrangements is prohibited

OHIC and the Attorney General are authorized to enforce the provisions, and OHIC may adopt rules and regulations for implementation
