Requires a circuit court judge (rather than a lower court) to set or deny bond for individuals charged with crimes carrying maximum sentences of three years or more who are suspected of being unlawfully present in the United States

Amends Section 17-15-30 of the South Carolina Code regarding bond determinations and conditions of release

Courts retain contempt powers to enforce the bond provisions

Takes effect upon approval by the Governor
