Attorney-legislators serving on the South Carolina Judicial Merit Selection Commission must recuse themselves from voting and screening any judge or justice before whom they have appeared as an attorney within the preceding five years

Attorney-legislators in the General Assembly must also recuse themselves from voting in joint session elections for judges or justices before whom they have appeared within the preceding five years

Members with conflicts must notify the commission or their respective legislative body of the potential conflict of interest before recusing themselves

The bill amends Sections 2-19-5 and 2-19-90 of the South Carolina Code regarding the Judicial Merit Selection Commission and judicial elections

Effective date: July 1, 2025
