Imposes a $500 civil fine plus court costs on individuals who refuse treatment after being administered an opioid antidote by a first responder following a fentanyl or opioid overdose, and are subsequently found under the influence of opioids again

Courts may substitute the fine with a requirement to complete an assessment through a Department of Alcohol and Other Drug Abuse Services (DAODAS) approved provider and follow treatment recommendations, including opioid treatment medications

Failure to pay the civil fine or complete the required assessment and treatment constitutes a misdemeanor punishable by up to 90 days imprisonment

Takes effect upon approval by the Governor
