Establishes that a parent's or caregiver's encouragement of a child to identify with their biological sex must be considered a "positive factor" in child custody, welfare, abuse, neglect, and foster care placement proceedings

Prohibits courts and agencies from treating affirmation of biological sex as evidence of abuse, neglect, or unfit parenting, even if a child has expressed "gender confusion"

Protects caregivers' right to refuse medical procedures such as hormone blockers, cross-sex hormones, or surgeries intended to alter a child's biological sex, without such refusal being considered abuse or neglect

Directs South Carolina agencies not to follow federal rules or policies that conflict with these provisions regarding gender identity affirmation in foster care placements

Requires the Department of Social Services and Family Court system to update policies accordingly and submit annual compliance reports to the General Assembly
