Director of the Department of Corrections may conditionally release inmates serving sentences for unlawful possession, manufacture, sale, or distribution of controlled substances before their scheduled release date

Eligibility requires serving at least 36 months or half the sentence (whichever is less), completing a chemical dependency treatment program in prison, no prior conditional release under this program, and no violent crime conviction in the past 10 years

Chemical dependency treatment programs must include structured daily schedules, individualized education and vocational training, self-worth programs, Department of Public Health licensing, and chemical use assessments

Inmates must sign contracts agreeing to random drug/alcohol tests, electronic or home monitoring, and have release plans addressing aftercare, community-based treatment, employment, and housing

Failure to complete the treatment program results in program participation time being added to the inmate's term of imprisonment, and conditional release can be rescinded without a hearing if deemed a public danger
