Limits prosecutorial discretion for law enforcement agencies regarding certain serious misconduct allegations (subsection A(3)(g)-(m)), requiring these cases to proceed to contested case hearings

Restricts prosecutorial discretion for all other misconduct allegations to cases where the evidence can no longer meet the preponderance of evidence standard

Requires law enforcement agencies that decline to prosecute misconduct allegations to submit detailed written reports explaining why they believe the allegations can no longer be proven

Mandates agency heads to appear before the South Carolina Criminal Justice Academy council to personally explain their decision not to prosecute misconduct allegations

Takes effect upon approval by the Governor
