Requires all law enforcement agencies operating correctional facilities in South Carolina to enter into written agreements with federal immigration enforcement agencies (such as ICE or CBP) to participate in the 287(g) program or similar federal programs authorizing enforcement of federal immigration laws

Agencies unable to secure an agreement must annually submit proof of their attempt to enter into one, along with reasons for noncompliance, to SLED's Illegal Immigration Enforcement Unit and the Attorney General's Office

Grants law enforcement officers authority to arrest individuals based on illegal alien status or federal immigration law violations when acting under a valid federal agreement

Provides immunity from damages or liability for law enforcement officers and government employees acting in good faith to enforce immigration laws under these agreements

Non-compliant agencies may face administrative penalties including oversight review, reporting obligations, or suspension of eligibility for discretionary grants through the Department of Public Safety
