Commercial data centers with peak demand of 100 megawatts or greater that consume 3 million or more gallons of water per month must report water usage annually to the Department of Environmental Services by January 31st

Reports must include the volume of surface water, groundwater, or other water sources used during the prior calendar year, plus anticipated water usage for the current year

The Department of Environmental Services may audit reports with 30 days advance notice to the data center

Civil penalties of up to $10,000 per day may be assessed for late filing after January 31st

A $10,000 civil penalty may be imposed for any inaccurate, misleading, or false information in the report
