State employees convicted of, or pleading guilty/nolo contendere to, criminal sexual misconduct with a minor or possession/distribution of child sexual abuse material (including AI-generated material) forfeit their state retirement and health benefits

Forfeited employees receive a refund of their own employee contributions to the retirement system, but lose employer-contributed benefits

Employees who lose benefits can recover 25% of the forfeited amount if they relocate to a state that does not border any state adjacent to South Carolina

Health benefits covered include those administered through the state employee insurance program; retirement benefits include any system administered under Title 9 of the S.C. Code

The act takes effect upon the Governor's approval
