Chinese-manufactured dialysate or dialysis products, as well as any dialysate or dialysis products containing aluminum, are deemed per se defective and unreasonably dangerous under South Carolina product liability law

Practitioners are prohibited from substituting dialysate or dialysis products with Chinese-made products or products containing aluminum or heavy metals for patients under 21 years old

Knowingly using, selling, prescribing, or distributing Chinese-made dialysate/dialysis products or those containing aluminum to patients under 21 is a criminal offense

Violations are punishable as a misdemeanor with fines up to $5,000 and/or imprisonment up to one year, with each sale constituting a separate offense

The Department of Public Health is directed to create regulations to enforce these provisions
