Establishes graduated penalties for repeat assault and battery in the third degree convictions when the offender has prior assault and battery convictions

First offense: fine up to $500 and/or up to 30 days imprisonment (unchanged from current law)

Second offense with prior assault/battery conviction: fine up to $750 or up to 60 days imprisonment

Third or subsequent offense with prior assault/battery conviction: fine up to $1,000 or up to 90 days imprisonment

Defines a prior conviction as one occurring within five years of the current offense and specifies that these offenses remain triable in magistrates court
