Creates tiered criminal penalties for Medicaid provider fraud based on dollar amounts: Class A misdemeanor for under $5,000, Class F felony for $5,000-$50,000 (up to 5 years imprisonment), and Class E felony for $50,000+ (up to 10 years imprisonment and $50,000 fine)

Establishes identical tiered penalties for Medicaid recipient fraud, replacing the previous single misdemeanor classification with escalating offenses based on the economic benefit sought or received

Requires courts to order full restitution to victims in addition to criminal penalties for both provider and recipient fraud convictions

Authorizes the Attorney General to issue administrative subpoenas and institute court proceedings to investigate and prosecute Medicaid fraud under Sections 43-7-60 through 43-7-80

Permits consent agreements between the Attorney General and alleged violators that include civil penalties or restitution without admission of guilt, which cannot be used in subsequent proceedings
